Council has 30 days to make a decision on the request for consent, which is by 27 December 2012. After the 30 day period, the applicant has 28 days in which to lodge an application for review with Victorian Civil Administrative Tribunal (VCAT). However this does not preclude Council from making a decision on the request for consent after the 30 day period.
The controls prepared in 1995 by Mirvac/State Government for this site vary from the normal planning processes and as a result there are no formal public notification or appeal rights for residents. However, Council is committed to hearing the views of the community prior to making a decision on the development.”
